Yes he is, and playing offline won't help due to the achievements showing up on the console. They can still detect the game data on the 360 whenever you take it online. So not playing the game online won't help one bit.

Pirate copies of HALO 3 ODST have now found their way online in English. This comes weeks after a broken street date in France led to the appearance of French pirate copies of the game.

This leak comes just a week before the end of embargos for the game's reviews on September 20th and its release on September 22nd. Unlike the French pirate version, the source of the English leak is unknown at this time.

The pirate download is now available to anyone with a modded Xbox 360 and takes up around 14GB of space for both discs. Microsoft threatened to permanently ban Xbox Live accounts found playing pirated copies of the French version. Although they haven't responded to the English leak, the same policy probably applies.

Old news, now that ODST is out.

Final thought: Microsoft did a good job at banning/taking care of piraters and noobs who can't wait a couple weeks. I'm very pleased and impressed with their actions.
